MINUTES

Representative Wagenius, Chair of the Committee on Environment, Natural Resources, and Agriculture Finance, called the meeting to order at 8:17 a.m., Thursday, April 4th, 2013 in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

HF1679 (Wagenius) Water use fees modified, and money appropriated.

Chair Wagenius moved HF1679 be laid over for possible inclusion in the Environment, Natural Resources, and Agriculture Finance Omnibus bill.

Chair Wagenius moved to amend HF1679 (see attached amendment H1679A1) THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

HF1679 as amended was laid over.

HF641 (Wagenius) as amended by the H0641DE2 amendment (previously heard on April 2nd 2013). Public water access site design and best management practice funding provided, and money appropriated.

Chair Wagenius moved HF641 as amended, be recommended to pass and re-referred to the Legacy Committee.

Chair Wagenius invited members of the audience to testify on HF641 as amended and HF1679 as amended.

Tom Ryan, Board Member - Greater Minnesota Regional Parks and Trails Council, Olmstead County, testified on HF641 as amended.

Mark Themig, Manager - Scott County Three Rivers Parks, testified on HF641 as amended.

Michael Schmidt, Water Quality Associate - Minnesota Center for Environmental Advocacy, testified on HF641 as amended.

John Jaschke, Director - Board of Water and Soil Resources, testified on HF641 as amended.

LeAnn Buck, Executive Director - Minnesota Association of Soil and Water Conservation Districts, testified on HF641 as amended.

Testifying on HF1679 as amended.

Alan Peterson, President - Irrigators Association of Minnesota, testified on HF1679 as amended.

Greg Jans, Dairy Farmer - Grove City, MN, testified on HF1679 as amended.

David Wagner, Chair - Saint Paul Regional Water Services and American Water Works Association, testified on HF1679 as amended.

Vice-Chair Falk moved approval of the committee meeting minutes for April 2nd. THE MOTION PREVAILED. THE MINUTES WERE APPROVED

The meeting recessed at 9:50 a.m.
The meeting reconvened at 6:10 p.m.

Vice-Chair Falk assumed the chair.

HF1679 as amended (Wagenius) Water use fees modified, and money appropriated.

Rep Wagenius moved to amend HF641 as amended (see attached amendment
H0641A9) THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Falk moved to amend HF641 as amended.
Chair Falk explained his amendment H0641A6 and answered questions from members of the Committee.

Steve Hirsch, Director, Ecological Services - Minnesota Department of Natural Resources, testified on H0641A6.

Kirk Koudelka, Assistant Commissioner - Minnesota Pollution Control Agency, testified on H0641A6.

Rep McNamara moved an oral amendment to H0641A6 as follows: after "2014." delete lines 1.12 through lines 1.17 River."

Rep McNamara requested a roll call vote on his oral amendment.

Rep McNamara withdrew his oral amendment.

Rep McNamara requested a roll call vote on HF641 as amended.

Chair Falk incorporated the following oral amendment into HF641 as amended: Line 1.7 after "mining" insert "in Big Stone County" and line 1.17, after "River" insert "in Big Stone County"

Rep McNamara renewed his motion to move an oral amendment to the HF641 as amended as follows: Line 1.12 delete "Until" Delete lines 1.13 through lines 1.16. Line 1.17 delete "Headwaters of the Minnesota River."

Rep McNamara withdrew his oral amendment.

Chair Falk withdrew his oral amendment.

Luke Skinner, Deputy Director, Parks and Trails - Minnesota Department of Natural Resources, testified on H0641A4.

Ray Bohn - All Terrain Vehicles Association, testified on H0641A4.

Chair Falk withdrew the H0641A4 amendment

Rep Torkelson moved to amend HF641 as amended (see attached H0641A1)
