JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Shimanski, Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:17 A.M. on February 9, 2012, in Room 10 (ground floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Anderson moved approval of the January 31, 2012 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

Representative Anderson moved SF 1183 be recommended to pass and be placed on the General Register.

Representative Hackbarth Presented SF1183 (Dill). State and municipal liability provided for claims involving certain nonprofit organizations.

Representative Anderson renewed her motion that SF 1183 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Representative Gauthier presented HF 1043 (Gauthier). Motor vehicle property crime penalties proposed for repeat violators.

Representative Johnson moved HF 1043 be recommended to pass and be placed on the General Register.

Representative Gauthier offered the H1043A1 Amendment to HF 1043.

Representative Johnson moved the H1043A1 Amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Gauthier offered the H1043A2 Amendment to HF 1043.

Representative Johnson moved the H1043A2 Amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Johnson renewed his motion that HF 1043 be recommended to pass, as amended, and be placed on the General Register. THE MOTION PREVAILED.

Representative Cornish presented HF 1535 (Cornish) DWI, off-highway vehicle, drive-by shooting, designated offense, and controlled substance forfeiture laws changes made to provide more uniformity; monetary cap raised on the value of property forfeitures that may be adjudicated in conciliation court; forfeited property prohibited from being sold to prosecuting authorities or persons related to prosecuting authorities; and general criminal code forfeiture law, necessity of conviction, and burden of proof clarified.

Representative Cornish moved HF 1535 be recommended to pass and be placed on the General Register.

Representative Cornish offered the H1535A5 amendment to HF1535
