JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Smith, Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:22 A. M. on April 28, 2011, in Room 10 (Ground Floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Hilstrom moved approval of the April 27, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

HF0006 (Cornish) Convicted sex offender indeterminate sentencing provided.

Representative Cornish moved that HF0006 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Cornish presented HF0006 and the H0006DE3 amendment.

David Brown, Hennepin County Attorneys Association, testified on HF0006.

Representative Smith laid over HF0006 and the H0006DE3 amendment for possible inclusion in an omnibus bill or further action at a later time.

Representative Smith recessed the hearing at 9:11 A.M.

Representative Smith reconvened the hearing at 9:39 A.M.

HF1023 (Smith) Courts authorized to seek partial payment or reimbursement of costs from a party proceeding in forma pauperis.

Representative Smith moved that HF1023 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Smith moved the H1023DE2 amendment.

Representative Johnson moved to orally amend the H1023DE2 amendment by removing ARTICLE 1, Section 17. THE ORAL AMENDMENT WAS INCORPORATED.

Representative Champion moved to orally amend the H1023DE2 amendment, as incorporated, by incorporating HF0718, as amended. THE ORAL AMENDMENT WAS INCORPRATED.

Representative Smith moved the H1023DE2 amendment, as incorporated. THE AMENDMENT WAS ADOPTED.

Representative Smith renewed the motion that HF1023, as amended, be recommended to pass and referred to the Ways and Means Committee. THE MOTION PREVAILED.

HF0556 (Smith) Juvenile prostitutes in need of protection or services provisions amended, sexually exploited youth defined, prostitution crime penalty assessments increased, and distribution of the assessment amended; prostitution laws provisions clarified and recodified, and definitions modified; money appropriated to the commissioner of public safety to develop a statewide victim services model.

Representative Smith moved that HF0556 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Smith moved the H0556DE1 amendment. THE AMENDEMNT WAS ADOPTED.

Representative Smith presented HF0556, as amended.

Nancy Haas, Messerli and Kramer/Minnesota County Attorneys Association and David Brown, Hennepin County Attorneys Association, testified on HF0556, amended.

Representative Smith renewed the motion that HF0556, as amended, be recommended to pass and re-referred to the Ways and Means Committee. THE MOTION PREVAILED.

HF0988 (Smith) Public defender representation provision modified.

Representative Smith moved that HF0988 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Smith presented HF0988

Representative Smith moved the H0988DE2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Smith renewed the motion that HF0988, as amended, be recommended to pass and re-referred to the Ways and Means Committee. THE MOTION PREVAILED.


Representative Smith adjourned the meeting at 10:00 A.M.
