JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Smith, Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:17 A. M. on March 10, 2011, in Room 10 (Ground Floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Shimanski moved approval of the March 8, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

HF0532 (Kieffer) Repeat criminal sexual conduct offender penalties enhanced.

Representative Smith moved HF0532 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Kieffer presented HF0532.

Erin Kuester, Assistant County Attorney, Goodhue County testified on HF0532.

Representative Smith laid over HF0532 for possible inclusion in an omnibus bill, or further action at a later time.

HF0469 (Gruenhagen) Harassment restraining order jurisdiction for petitions provided.

Representative Gruenhagen moved that HF0469 be recommended to pass and re-referred to the Civil Law Committee.

Representative Gruenhagen presented HF0469.

Caroline Palmer, MNCASA Staff Attorney, testified on HF0469.

Representative Gruenhagen renewed his motion that HF0469 be recommended to pass and re-referred to the Civil Law Committee. THE MOTION PREVAILED.

HF0738 (Cornish) Harassment restraining order provisions modified.

Representative Cornish moved that HF0738 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee.


Representative Cornish moved the H0738A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Cornish presented HF0738, as amended.

Rhonda Fuller, Battered Women's Legal Advocacy Project and Liz Richards, Director of Program, MCBW testified on HF0738, as amended.

Representative Cornish renewed his motion that HF0738, as amended, be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee. THE MOTION PREVAILED.

HF0439 (Smith) Consecutive sentences for assaults committed by state prison inmates provision clarified.

Representative Smith moved that HF0439 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee. THE MOTION PREVAILED.

HF0660, as amended, (McDonald) Repeat sex offender 36-month presumptive executed sentence provided.

Representative Smith moved that HF0660, as amended, be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee. THE MOTION PREVAILED.

Representative Smith adjourned the meeting at 9:05 A.M.
