JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Smith, Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:19 A. M. on March 8, 2011, in Room 10 (Ground Floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Kriesel moved approval of the March 3, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

HF0642 (Slocum) Child certified as an adult provided to be detained in a juvenile facility prior to trial and verdict.

Representative Smith moved HF0642 be recommended to pass and referred to the Public Safety and Crime Prevention Policy and Finance Committee.

Representative Smith moved the A11-0105 amendment. THE AMENDMENT WAS ADOPTED.

Representative Slocum presented HF0642, as amended.

Captain Mike Wresh, Hennepin County Sherriff's Office and Jim Grathwol, Minneapolis Public Schools testified on HF0642, as amended.

Representative Smith renewed the motion that HF0642, as amended, be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee. THE MOTION PREVAILED.

Representative Shimanski assumed the gavel at 8:33 A.M.

HF0361 (Kriesel) Fleeing a police officer crime modified.

Representative Kriesel moved that HF0361 be recommended to pass and placed on the General Register.

Representative Kriesel presented on HF0361.

Sgt. Anne Deneen, Minneapolis Park Police, Mike Bedard, Brother of Officer Mark Bedard, and David Brown, Assistant Hennepin County Attorney testified on HF0361.

Representative Smith renewed the motion that HF0361 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF0660 (McDonald) Repeat sex offender 36-month presumptive executed sentence provided.

Representative Smith moved HF0660 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance Committee.

Representative Smith moved to orally amend HF0660, Line 1.9: delete "subdivision" and insert "subdivisions" and Line 1.10: delete "with" and insert "within". THE ORAL AMENDMENT WAS ADOPTED.

Representative McDonald presented HF0660, as amended.

Caroline Palmer, MNCASA and Jill Payne, Sentencing Guidelines Commission testified on HF0660, as amended.

Representative Smith laid over HF0660, as amended, for possible inclusion in an omnibus bill, or further action at a later time.

HF0479 (Kahn) Water pipe fluid weight use established when determining weight or amount of controlled substance.

Representative Smith moved that HF0479 be recommended to pass and placed on the General Register.

Representative Kahn presented HF0479.

Representative Smith renewed his motion that HF0479 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF0152 (Cornish) Criminal possession or sale of identification documents crime created.

Representative Cornish moved HF0152 be recommended to pass and re-referred to the Ways and Means Committee.

Representative Cornish presented HF0152.

Teresa Nelson, ACLU of MN testified on HF0152.

Representative Smith laid over HF0152 for possible inclusion in an omnibus bill, or further action at a later time.

Representative Shimanski assumed the gavel at 9:43 A.M.

HF0439 (Smith) Consecutive sentences for assaults committed by state prison inmates provision clarified.

Representative Smith moved that HF0439 recommended to pass and referred to the Public Safety and Crime Prevention Policy and Finance Committee.

Representative Smith presented HF0439.

Representative Shimanski laid over HF0439 for possible inclusion in an omnibus bill, or further action at a later time.

Representative Smith assumed the gavel at 9:46 A.M.

Representative Smith adjourned the meeting at 9:47 A.M.
