HEALTH AND HUMAN SERVICES REFORM COMMITTEE

MINUTES

Representative Gottwalt, Chair, of the Health and Human Services Reform Committee, called the meeting to order at 2:34 P.M. on April 12, 2011, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

HF928 (Falk) Publicly owned nursing facility cost additional local share clarified, and publicly owned nursing facility payment rate clarified.

Representative Gottwalt moved that HF928 be recommended to pass and be sent to the General Register.

Representative Falk testified on HF928.

Representative Gottwalt renewed his motion that HF928 be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

HF979 (Lanning) Uniform asset limit requirement analysis required across human service assistance programs.

Representative Gottwalt moved that HF979 be recommended to pass and be sent to the General Register.

Testifying in HF979 were Representative Lanning, Jessica Webster, Staff Attorney, Legal Services Advocacy Project, and Deborah Schlick, Executive Director, Affirmative Options Coalition.

Representative Gottwalt renewed his motion that HF979 be recommended to pass and be sent to the General Register. THE MOTION PREVAILED.

HF122 (Davids) Dental plan contracts and provider audits regulated.

Representative Gottwalt moved that HF122 be recommended to pass and be re-referred to the
Committee on Commerce and Regulatory Reform.

Representative Gottwalt moved the H0122A1 amendment. THE AMENDMENT WAS ADOPTED.

Testifying on HF122 were Representative Davids and Dominic Sposeto, Minnesota Dental Association
Dr. Michael Flynn, Minnesota Dental Association, David Aafedt, Winthrop and Weinstine, PA
Joseph Lally, Vice President, Delta Dental of Minnesota and Bob Johnson, Insurance Federation of Minnesota.

Representative Gottwalt renewed his motion that HF122, as amended, be recommended to pass and be re-referred to the Committee on Commerce and Regulatory Reform. THE MOTION PREVAILED.

HF1339 (Abeler) My Life, My Choices Task Force established.

Representative Abeler moved that HF1339 be recommended to pass and be referred to Government Operations and Elections.

Representative Abeler moved the H1339A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Abeler moved to orally amend HF1339 by: P.1, L1.1, "delete" partner and "insert" advocate. THE ORAL AMENDMENT WAS ADOPTED.

Representative Liebling moved to orally amend HF1339 by: P.2, "delete" L. 2.12. THE ORAL AMENDMENT WAS ADOPTED.

Testifying on HF1339 were Representative Abeler and Mark Peterson, President and CEO, Lutheran Social Services.

Representative Abeler renewed his motion that HF1339, as amended, be recommended to pass and be referred to Government Operations and Elections. THE MOTION PREVAILED.

HF1087 (McElfatrick) Nursing; criminal history record check required, and money appropriated.

Representative McElfatrick moved that HF1087 be recommended to pass and be re-referred to the Committee on HHS Finance.

Representative McElfatrick moved the H1087A1 amendment. THE AMENDMENT WAS ADOPTED.

Testifying on HF1087 were Representative McElfatrick Shirley Brekken, Executive Director, Minnesota Board of Nursing, Rich Newmeyster, Twila Brase, Citizens' Council on Health Care, Mark Haase,
Council on Crime and Justice, Jerry Kerber Minnesota Department of Human Services, and Mary Jo George, Minnesota Nurses Association

Representative McElfatrick moved that HF1087, as amended, be recommended to pass and be re-referred to the Committee on Civil Law without recommendation. THE MOTION PREVAILED.

HF1138 (Abeler) Case management and personal care assistance appeals conference required.

Representative Abeler moved that HF1138 be recommended to pass and be re-referred to the General Register.

Testifying on HF1138 were Representative Abeler, Anne Henry, Minnesota Disability Law CenterJulie Ring, Local Public Health Association of Minnesota.

Representative Abeler moved that HF1138 be laid over. THE MOTION PREVAILED.

Representative Quam assumed the gavel at 4:05 P.M.

Representative Benson assumed the gavel at 4:10 P.M.

HF1185 (Abeler) Contracting procedures between health care providers and health plan companies adjusted.

Representative Abeler moved that HF1185 be recommended to pass and be re-referred to the Committee on Commerce and Regulatory Reform.

Representative Abeler moved the H1185A1 amendment.

Representative Abeler withdrew the H1185A1 amendment.

Representative Gruenhagen assumed the gavel at 5:15 P.M.

Testifying on HF1185 were Representative Abeler, Geoff Bartsch, Medica, David Olsen, President and CEO, HSM

Representative Abeler moved that HF1185 be recommended to pass and be re-referred to the Committee on Commerce and Regulatory Reform. THE MOTION PREVAILED.

Representative Gottwalt assumed the gavel at 5:17 P.M.

HF912 (Abeler) Special family day care homes requirement provided.

Representative Abeler moved that HF912 be recommended to pass and be placed on the General Register.

Representative Abeler testified on HF912.

Representative Abeler renewed his motion that HF912 be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Representative Gottwalt laid over HF1166 for consideration on April 13, 2011.

The meeting was adjourned at 5:32 P.M.
