MINUTES


Representative Kory Kath, Vice-Chair of the K-12 Education Policy & Oversight Committee, unofficially called the forty-sixth meeting to order at 8:34 AM on Tuesday, March 2, 2010 in the Basement hearing room of the State Office Building.

The Committee Legislative Assistant noted the roll:

HF 58 (Mullery) - A bill for an act relating to education; teaching middle school students about the juvenile and criminal justice systems and the consequences of delinquent and criminal conduct; amending Minnesota Statutes 2008, section 120B.023, subdivision 2.

Rep. Mullery presented HF 58.

Chair Kath officially called the hearing to order at 8:40 AM. A quorum was present.

Rep. Newton moved the minutes of February 25, 2010, be adopted. THE MOTION PREVAILED. THE MINUTES WERE ADOPTED.

Chair Kath moved that HF 58 be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.

Questions and discussion followed.

Ms. Amy Walstien, Director of Public Relations, Minnesota Department of Education, testified to HF 58.

Rep. Kath renewed his motion that HF 58 be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division. THE MOTION DID NOT PREVAIL.

HF 2962 (Fritz) – A bill for an act relating to education; providing for a trial placement at the Minnesota Academy for the Deaf and the Minnesota Academy for the Blind; amending Minnesota Statutes 2008, section 125A.69, subdivision 1.

Chair Kath moved that HF 2962 be recommended to pass and referred to the Committee on Finance, with a recommended referral to the K-12 Finance Division.

Rep. Fritz presented HF 2962.

Testifying on behalf of HF 2962 was:

Chair Kath laid over HF 2962.

HF 3115 (Norton) – A bill for an act relating to education; requiring statewide physical education standards; requiring a report; establishing a healthy kids awards program; amending Minnesota Statutes 2008, section 120B.021, subdivision 1; proposing coding for new law in Minnesota Statutes, chapter 121A.

Rep. Norton moved that HF 2962 be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.

Rep. Norton moved the H3115A1 amendment, with the following incorporations:

Page 1, Line 5, delete "must" and insert "may"
Page 1, Line 11, delete "must" and insert "may"
Page 1, Line 12, delete "that" and insert "an"
Page 3, Line 12, delete "must" and insert "may"
Page 3, Line 18, delete "must" and insert "may"
Page 1, Line 19, delete "that" and insert "an"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Norton and Rep. Dettmer presented HF 3115, as amended.

Rep. Mariani moved the following oral amendment to HF 3115, as amended:

Page 3, Line 6 "required when reviewing or revising standards and benchmarks," and insert "other laws to the contrary,"
Page 3, Line 7, after "shall" insert "initially"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Testifying on behalf of HF 3115, as amended:

Rep. Norton renews her motion that HF 3115, as amended, be recommended to pass and referred to the Committee on Finance, with a recommended re-referral to the K-12 Finance Division.
