MINUTES


Representative Gene Pelowski, Chair of the State & Local Government Operations, Reform, Technology and Elections Committee, called the meeting to order at 8:30 A.M. on Thursday, March 4, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Poppe moved that the minutes of March 3, 2010, be approved. THE MOTION PREVAILED.

Representative Winkler moved that HF3108 be recommended to pass and sent to the General Register.

Representative Winkler moved to amend HF3108 (see attached H3108DE1).

Representative Winkler moved to amend the H3108DE1 amendment as follows:

Page 3, line 5, reinstate "may" and delete "shall"

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Winkler presented HF3108 (Winkler), as amended, a bill for an act relating to elections; changing and clarifying certain provisions; etc.

Representative Simon moved to amend HF3108, as amended, (see attached A10-2185)
by incorporating the following amendments:

Page 1, line 1, after "amend", insert "H"; Page 1, line 1, after "No.", insert "3108, the delete-everything amendment"

Page 1, line 2, after "Page" insert "36", and after "line", insert "5"

Page 2, line 6, delete "special or regularly scheduled election is held." And insert,

"successor is elected and qualified."

Page 2, line 10, after "Page" insert "36", and after line, insert "21"

Page 2, line 11, after "Sec." Insert "71"

Representative Winkler moved to amend HF3108, as amended, as follows:

Page 34, line 33, delete "local" and insert "a"

Page 34, line 33, delete "agencies" and insert "agency has"

Page 35, line 1, delete "have"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Winkler renewed the motion that HF3108, as amended, be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

Representative Simon moved that HF224 be recommended to pass and re-referred to the Committee on Civil Justice.

Representative Simon moved to amend HF224 (see attached H0224DE1).

Representative Simon moved to incorporate a technical amendment to amendment H0224DE1 as follows:

Page 10, line 11, delete "8" and insert "9"

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Simon presented HF224 (Simon), as amended, a bill for an act relating to judicial selection; proposing an amendment to the Minnesota Constitution; etc.

Representative Simon renewed the motion that HF224, as amended, be recommended to pass and re-referred to the Committee on Civil Justice.

Representative Buesgens requested a roll call vote on the motion.

Voting aye: Pelowski, Anderson, P., Gottwalt, Hilty, Hornstein, Kahn, Kalin, Marquart, Nelson, Poppe, Sanders, Simon, Sterner and Winkler.

Voting nay: Buesgens, Emmer, Kiffmeyer and Lanning.

There were 14 ayes and 4 nays. THE MOTION PREVAILED.

The meeting was adjourned at 10:04 A.M.
