Representative Dennis Ozment, Chair of the Agriculture, Environment and Natural Resources Finance Committee called the forty-sixth meeting to order on Tuesday, May 10, 2005, at

5:45 p.m.

The Clerk noted the roll.

A quorum was present.


Representative Magnus moved to approve minutes of May 4, 2005. THE MOTION PREVAILED.


HF 826 (Ozment) Clean Water Legacy Act established providing authority, direction, and funding to achieve and maintain water quality standards for surface waters in accordance with the federal Clean Water Act, and money appropriated.


Representative Ozment moved Amendment H0826A38.

Research staff John Helland explained Amendment H0826A38 to H0826UE1.

Testifing on Amendment H0826A38 was:

Glenn S. Dorfman, Mn Association of Realtors.
Fiscal staff Jim Reinholdz explained Amendment H0826A38.
Representative Ozment incorporated the following to Amendment H0826A38:

Page 2, Line 30, insert after fee “less the cost to collect fees,”
Page 7, line 16, delete section 19.

Representative Juhnke moved to vote on Amendment H0826A38 in two separate divisions.

First, on Article 2 and Article 3. THE MOTION PREVAILED.

Second, on Article 1. THE MOTION PREVAILED.

Representative Wagenius moved Amendment H0826A33 to H0826EU1.

Representative Wagenius moved to amend Amendment H0826A33 as follows:

Page 1, line 2 and line 4, delete “9” and insert “10”.


THE MOTION PREVAILED.

Representative Wagenius moved Amendment H0826A32 to H0826UE1.

THE MOTION DID NOT PREVAIL, THE AMENDMENT WAS NOT ADOPTED.

Representative Ozment moved Amendment H0826A36 to H0826UE1.

Representative Ozment laid over Amendment H0826A36 for possible further discussion.

Representative Ozment moved Amendment H0826UE1, as amended.

Representative Ozment moved to amend Amendment H0826UE-1 as follows:

Page 26, line 14 - after and delete “$. . . . . is”

THE MOTION PREVAILED.

Representative Ozment renewed his motion that HF 826, as amended, pass and be re-referred to the Tax Committee. THE MOTION PREVAILED.
